Supreme Court of Canada Rules on Landmark Spousal Support case
Spousal support is often the most contentious issue in Divorce negotiations. The Supreme Court of Canada ruled on December 21, 2011 that spouses who agree on spousal support payments will face an uphill battle if they try and change that agreement in the future and that in order to do so; there will be a very heavy burden of proof on the applicant.
We meet with many clients who just want to get their agreement signed and over with; we always encourage men and women to take the time to seek legal counsel, to give the issue a great deal of thought and to truly understand all of the financial and tax implications of this decision both in the short and long term.
This ruling should encourage clients, both the receivers and payors of spousal support to take the time to do their due diligence as financial decisions most often are permanent ones.
